Organizer of the Competition

The organizer of this competition is BEDNAR FMT s.r.o., with its registred office at Lohenická 607, 190 17 Praha 9 – Vinoř, reg. number: 25098781, registred in the Commercial Register administered by the Municipal Court in Prague, section C, file no. 49530., BEDNAR FMT s.r.o. (hereinafter also referred to as the “competition organizer”) is responsible for data protection and is the contact person for questions regarding the competition.

Eligibility

All natural persons who are resident in the European Union and have reached the age of 18 who have correctly followed the advertised competition rules are eligible to participate. Excluded are employees of the organizer, their families, representatives, and all persons who are professionally in contact with this giveaway (“participants”). No purchase of goods from the organizer is required, but a valid Instagram account as well as internet access is required.

Giveaway Duration

The duration of the giveaway is from Monday, 06/01/2024 until Sunday, 06/07/2024 11:59PM (Central European Time).

Participation

a. Participants must log in with their Instagram account (or create one for free), and become or already be a follower of @BEDNAR_FMT and @Spinar24HD on Instagram.

b. Then the participant must like the giveaway post and comment under the post tagging two friends.

c. By participating in the giveaway, the participant grants the organizer the non-exclusive, territorial, and temporally unrestricted right of use to reproduce, publish, and make available the entries on the organizer’s website and social media platforms without compensation.

d. All entries must be submitted by the end of the giveaway period to be valid.

e. A maximum of one entry per entrant is permitted on Instagram per giveaway period.

Winning and Determination of Winners

After the end of the giveaway, three winners will be selected from all eligible participants.

First Prize: Model of KATOR KN + Sweatshirt Spinar24HD
Second Prize: Model of SWIFTER SO 6000 F + T-shirt Spinar24HD
Third Prize: Model of TERRALAND TN + Tin mug Spinar24HD
Cash payment of the prize is excluded. Winning claims cannot be transferred or assigned to other persons. Legal recourse is excluded with regard to the drawing of the winners and the assessment of the content of the submitted giveaway entries.
Only those participants who meet all the conditions of the competition will be entered into the competition and can become winners. The Organizer reserves the right to assess the fulfilment of the conditions of participation by individual participants at any time at its sole discretion.
Participants acknowledge that only one winner can receive each individual prize at any one time. The decision as to which of the prizes the winner will receive is at the sole discretion of the Organiser. The Organiser is not bound by the winner’s choice of prize when deciding how to distribute the prizes to the winners.

Notification and Feedback

The winners will be notified after the end of the giveaway period under their participation comment and asked to report back via direct message (DM). They will have 4 days after the initial contact to respond to confirm their selection and accept the prize. In the event that any of the winners do not respond within 4 days of the initial contact, the Promoter reserves the right to disqualify that winner and select another.

The participant is responsible for the accuracy of the contact details provided. If the winner cannot be notified due to incomplete or incorrect contact details, the claim to the prize will be forfeited. In this case, the prize will be awarded to another participant. The prize is only redeemable as advertised and only in the specified period subject to availability.

Exclusion and Premature Termination

Participants who are suspected of technical manipulation of the competition will be excluded from the competition. The giveaway organizer reserves the right to interrupt or terminate the giveaway at any time without prior notice and without giving reasons, provided that this is reasonable and acceptable to the participants. This option will only be used if for technical or legal reasons a proper execution of the competition cannot be guaranteed and the termination is reasonable for the participants. If it turns out that the winner is not entitled to the prize under these rules for any reason, or if the winner declines the prize, it is at the Organiser’s sole discretion whether to designate another participant who has also fulfilled all the conditions for participation in the competition as the winner or to use the prize in another way.

Granting of Rights of Use

By participating, each participant agrees that his/her name, including place of residence, may be published on Instagram on the Internet and in print media of the company in the event of winning.

a. The Promoter shall not be liable to the Winner for any loss or damage of any kind (whether in contract, tort, statutory duty, or otherwise) arising out of or in connection with the Competition and the Prize. This does not apply to personal injury or if the damage is caused by intent or gross negligence on the part of the Promoter.

b. The organizer and its representatives are not responsible for the non-inclusion of entries as a result of technical failures or for other reasons. Proof of submission of the entry is not proof of receipt of the entry. The Promoter accepts no responsibility for system failures or other problems resulting in lost, late, or non-received entries or notifications from the Winner.

c. By entering the Giveaway, entrants acknowledge that they have read and accept these Terms and Conditions. Any violation of these terms and conditions by the participant may result in the forfeiture of the prize.

The giveaway is subject to the laws of the Czech Republic and Czech jurisdiction.

Notices and Conditions of Instagram

In addition to these Terms and Conditions of Participation, the relationship between BEDNAR FMT, the participant, and Meta is governed by the Terms and Conditions of Participation and Meta’s Privacy Policy. Participants may not assert any claims against Meta arising in connection with participation in and use of the Giveaway. Participants acknowledge that the Giveaway is in no way sponsored, endorsed, organized, or associated with Meta. All information and data provided by or collected from users in connection with the Giveaway will be provided only to BEDNAR FMT and not to Meta. All inquiries and comments regarding the competition should be addressed to BEDNAR FMT and not to Meta.

Data Protection Declarations

By participating in the competition, the participant expressly agrees that the competition organizer may process the necessary data for the purpose of conducting the competition and presenting the winners. The processing is carried out on the basis of Article 6 (1) (a) GDPR in the case of consents and agreements and on the basis of Article 6 (1) (b) GDPR in the case of the implementation of the competition. Statistical evaluations are carried out on the basis of our legitimate interests (i.e., interest in the analysis, optimization, and economic operation of our online offer within the meaning of Article 6 (1) (f) GDPR). In this regard, we use the data to evaluate and improve our giveaways. In doing so, no profiles of the users are created, but results are aggregated, i.e., processed anonymously. As the person responsible for data protection, the giveaway organizer observes the relevant legal provisions. Personal data will not be passed on or sold to third parties unless otherwise stipulated in these conditions of participation. After the end of the competition, the stored participant data will be deleted or made anonymous, unless the participants have consented to further use of the data or the deletion conflicts with statutory retention obligations.

Participants have the right, upon request and free of charge, to receive information about the personal data stored about them by the competition organizer. In addition, participants have the right to correct incorrect data, block and delete their personal data, if applicable, to assert their rights to data portability and, in the event of the assumption of unlawful data processing, to file a complaint with the competent supervisory authority. Participants can also revoke their consent, in principle with effect for the future. The data stored by the competition organizer or on its behalf will be deleted as soon as it is no longer required for its intended purpose and the deletion does not conflict with any legal obligations to retain data.
In the event that a participant believes that their rights in the area of personal data protection are being violated, they may file a complaint with the supervisory authority, which is the Office for Personal Data Protection ([http://www.uoou.gov.cz)]www.uoou.gov.cz).
To exercise your rights, send an e-mail to: [email protected] or a letter to the address of the company´s registered office. Depending on the nature of the data, you may be required to prove your identity.

Right of Objection

Participants may object to the future processing of their personal data in accordance with the legal requirements at any time. The objection can be made in particular against processing for direct advertising purposes.
